Actions on applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law; the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). The final action on each application also constitutes action on the NPDES permit application and, if noted, the request for a Section 401 Water Quality Certification. To revise the permit for the Tunnel Ridge Mine in Donegal and West Finley Townships, Washington County and related NPDES permit. In conjunction with this approval, the Department is granting 401 Water Quality Certification certifying that the approved activities will comply with the applicable provisions of sections 301—303, 306 and 307 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341) and will not violate applicable Federal and State water quality standards. FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. The project is located approximately 0.06 mile northeast of the Lake Shore Drive and Paiute Path intersection (Thorn-hurst, PA Quadrangle Latitude: 41° 9` 19.55"; Longitude: -75° 33` 49.20") in Tobyhanna Township, Monroe County. E48-439. Bethlehem Commerce Center, LLC, 3001 Commerce Center Boulevard, Bethlehem, PA 18015. City of Bethlehem, Northampton County, Army Corps of Engineers Philadelphia District.

 To authorize the following water obstruction and encroachments within a tributary to the East Branch Saucon Creek (CWF, MF) with work consisting of a stream restoration and realignment within a 3,000-foot reach.

 1. To construct and maintain 708 feet of stream work consisting of grading of the stream channel, step pools, cross vanes and placement of R-6 riprap. The channel will consist of a 10-foot bottom width, 2:1 side slopes and an average bed slope of 3 percent.

 2. To maintain an existing stream enclosure consisting of replacement in-kind of 20-feet of the existing stream enclosure and removal of silt and debris.

 3. To construct and maintain a endwall on the downstream end of duel 7-foot diameter culverts.

 The project is located along Applebutter Road (Hellertown, PA Quadrangle Latitude: 40°37`1.14"; Longitude: -75°19`19.86") in the City of Bethlehem, Northampton County. Subbasin 2C.

E52-256. Pennsylvania Department of Transportation, Engineering District 4-0, 55 Keystone Industrial Park, Dunmore, PA 18512. Greene and Palmyra Townships, Pike County, Army Corps of Engineers Philadelphia District.

 Authorize the following water obstructions and encroachments associated with roadway improvements along SR 0084, Section 450:

 1. To remove the existing structures and to construct and maintain two road crossings carrying Eastbound and Westbound SR 0084 over Wallenpaupack Creek (HQ-CWF, MF), consisting of 2, 280-foot long three-span pre-stressed concrete bulb-tee beam bridges, both constructed with a 30-degree skew to the stream flow on concrete piers and abutments (S-SRC-03).

 2. To remove an existing endwall from a stormwater outfall pipe and to construct and maintain a new concrete endwall with riprap outlet apron within the floodway of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF) (S-SRC-11).

 3. To remove the existing structure and to construct and maintain a 103-foot long stream enclosure of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 24-inch diameter reinforced concrete pipe (RCP) connecting two EV wetlands (S-PIPE-02).

 4. To remove the existing structure and to construct and maintain an in-kind stream enclosure at the same location of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 204-foot long, 36-inch diameter RCP depressed 6 inches below streambed elevation with concrete endwalls and riprap outlet apron (S-SRC-08A & S-SRC-08).

 5. To repair and maintain an existing stream enclosure of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 590-foot long, 8-foot wide box culvert with concrete endwalls (S-SRC-10).

 6. To repair and maintain an existing stream enclosure of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 328-foot long, 8-foot wide box culvert with concrete endwalls (S-SRC-13).

 7. To remove an existing structure and to construct and maintain an in-kind stream enclosure at the same location of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 299-foot long, 24-inch diameter RCP to connect two EV wetlands with no open water component (S-PIPE-03).

 8. To construct and maintain a 42-inch diameter RCP stormwater outfall within the floodway of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a pipe, concrete endwall, riprap outlet protection and minor grading within the stream channel to connect with the new pipe (S-SRC-44).

 9. To maintain an existing stream enclosure of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 216-foot long, 42-inch diameter RCP with concrete endwalls which connects two EV wetlands with no open water component (S-PIPE-01 EB).

 10. To maintain an existing stream enclosure of an unnamed tributary to Wallenpaupack Creek (HQ-CWF, MF), consisting of a 136-foot long, 42-inch diameter RCP which connects two EV wetlands with no open water component, replace the concrete endwalls in-kind, and to replace in-kind 40 l.f. of the existing stream enclosure. (S-PIPE-01 WB).

 11. To remove an existing headwall and to construct and maintain a replacement concrete headwall at the south end of an existing stream enclosure of an un- named tributary to Lake Wallenpaupack (HQ-CWF, MF) (S-SRC-14 EB).

 12. To maintain an existing stream enclosure of an unnamed tributary to Lake Wallenpaupack (HQ-CWF, MF), consisting of a 195-foot long, 48-inch diameter CMP which connects two EV wetlands with no open water component (S-SRC-38).

 13. To remove the existing structure and to construct and maintain a stream enclosure of an unnamed tributary to East Branch Wallenpaupack Creek (HQ-CWF, MF), consisting of a 337-foot long, 36-inch diameter RCP with concrete endwalls which connects two EV wetlands (S-JRG-05).

 14. To maintain an existing stream enclosure of an unnamed tributary to Kleinhans Creek (HQ-CWF, MF), consisting of a 360-foot long, 42-inch diameter CMP with concrete endwalls (S-SRC-33).

 15. To temporarily disturb 11 linear feet of an unnamed tributary to Kleinhans Creek (HQ-CWF, MF) to access an existing downstream stream enclosure for maintenance purposes (S-SRC-34).

 16. To temporarily disturb 73 linear feet of an unnamed tributary to Kleinhans Creek (HQ-CWF, MF) to access and construct a proposed fill slope (S-SRC-35).

 17. To repair and maintain an existing stream enclosure of an unnamed tributary to Kleinhans Creek (HQ-CWF, MF), consisting of a 314-foot long, 8-foot wide concrete box culvert with concrete endwalls (S-SRC-38 EB).

 18. To repair and maintain an existing stream enclosure of an unnamed tributary to Kleinhans Creek (HQ-CWF, MF), consisting of a 411-foot long, 8-foot wide concrete box culvert with concrete endwalls (S-SRC-38 WB).

 19. To place and maintain riprap outlet protection within an unnamed tributary to Kleinhans Creek (HQ-CWF, MF), along with 24 square feet of temporary disturbance for access to the work area (S-SRC-30 EB).

 20. To replace and maintain 10 linear feet of 36-inch diameter RCP and a concrete endwall at the downstream end of an existing stream enclosure of an unnamed tributary to Kleinhans Creek (HQ-CWF, MF) (S-SRC-30 WB).

 To construct and maintain: 1) a 330-foot long by 70-foot wide road, permanently impacting 0.20 acre of exceptional value palustrine emergent wetlands. The crossing includes an 8 inch diameter, ductile iron water pipe; 2) an 18-inch diameter HDPE pipe outfall with R-4 rock riprap scour protection in an unnamed tributary to Donegal Creek (CWF, MF); 3) a 24.0-inch ADS pipe outfall with concrete headwall and rip rap apron in an unnamed tributary to Donegal Creek (CWF, MF); 4) to place and maintain fill in 0.01 acre of palustrine emergent wetlands; and 5) to temporarily impact 215 square feet of exceptional value palustrine emergent wetlands for the construction of onsite replacement wetlands. The project is located near the intersection of Merts Drive and Cloverleaf Road (Latitude 40°08`44", Longitude -76°33`47") in Mount Joy Township, Lancaster County. To compensate for the wetland impacts, the permittee is required to provide 0.39 acre of replacement wetlands onsite. The permit was issued on August 2, 2018.
