Application Period for Temporary Structure Consumer Fireworks Facility Licenses

 The Department of Agriculture (Department) is authorized under Article XXIV of the Tax Reform Code of 1971 (72 P.S. §§ 9401—9416) to issue licenses allowing the sale of certain types of consumer fireworks from temporary structures annually from June 15 through July 8 and from December 21 through January 2.

 The Department gives notice of the window within which it will accept license applications from persons who seek a license and who wish to sell consumer fireworks during the June 15, 2018, through July 8, 2018, sales period and the earliest date sales of consumer fireworks may begin if a license is issued for that period.

 1. With respect to any application for a temporary structure consumer fireworks facility license delivered to the Department on or before June 1, 2018, if the Department issues the license the earliest date upon which the licensee may begin sales of consumer fireworks is June 15, 2018.

 2. With respect to any application for a temporary structure consumer fireworks facility license delivered to the Department between June 2, 2018, and June 12, 2018, if the Department issues the license the earliest date upon which the licensee may begin sales of consumer fireworks is June 23, 2018.

 3. The deadline is June 12, 2018, for delivering to the Department an application for a temporary structure consumer fireworks facility license for the June 15, 2018, through July 8, 2018, sales period.

 4. With respect to any application for a temporary structure consumer fireworks facility license delivered to the Department after June 12, 2018, for any and all future sales periods, if the Department issues the license the earliest date upon which the licensee may begin sales of consumer fireworks shall be the 61st day after the license application was received by the Department.

 The date of delivery of a license application is the date it is received and time-stamped at the Department's Bureau of Ride and Measurement Standards, 2301 North Cameron Street, Harrisburg, PA 17110-9408.
