Amendment to the 2016 and 2017 Annual Action Plans

 The Commonwealth's 2016 and 2017 Annual Action Plans will be amended to clarify the Method of Distribution (MOD)—Threshold limits for the HOME Program. This action requires no citizen comment.

 Annually the Department of Community and Economic Development (Department) prepares the Action Plan which outlines the method of distribution for Federal funding received by the Department. The 2016 and 2017 Action Plans for these funds were finalized and submitted to the United States Department of Housing and Urban Development for review on April 18, 2016, and August 15, 2017, respectfully. The Department is clarifying the MOD to the HOME Program for both years as two sections of the MOD appear to contradict each other.

 The Fiscal Year (FY) 2016 and 2017 Action Plans required clarification to address conflicting information/language in the MOD criteria and threshold sections of the HOME Program. In the criteria section, the Department included language in both the FY 2016 and FY 2017 Action Plans specific to the HOME MOD to increase the amount of funds available to applicants of HOME rental developments, nine units or less, up to the per unit subsidy limits for the area where the rental development is or will be located depending upon the program underwriting requirements. The HOME MOD also contains language specific to amount of grant an applicant may apply for in the threshold section. The grant amount is capped at $1 million without qualification and this conflicted with the language and amount available for HOME rental developments of nine units or less as indicated in the criteria section. Clarifications were made to both the 2016 and 2017 HOME MOD language in the threshold section to define the parameters of the level of grant awards. The wording now in the threshold section is:

Because of the complexity of federal regulations and requirements associated with the HOME Program, a minimum application amount of $50,000 has been established, except for CHDO operating grants and project specific predevelopment loans. All other HOME activities except rental development, have a maximum grant level of $500,000 for any HOME application covering a single municipality or $750,000 for assistance for multiple municipalities. DCED reserves the right to increase the contract amounts above this level for warranted reasons, but that level will not be over $1,000,000.
For rental development projects of 9 units or less, the project may be funded to the per unit subsidy limits applicable to the project area and meeting the underwriting requirements of the HOME program.
