LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P.S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

 For further information concerning plans or reports, contact the environmental cleanup program manager in the Department regional office under which the notice of receipt of plans or reports appears. If information concerning plans or reports is required in an alternative form, contact the community relations coordinator at the appropriate regional office. The Report is intended to document remediation of the site to meet the Site Specific Standard.

Turkey Hill # 76 Minit Mart, 2101 New Danville Pike, Lancaster, PA 17603, Pequea Township, Lancaster County. Letterle & Associates, Inc., 2022 Axemann Road, Suite 201, Bellefonte, PA 16823, on behalf of Keystone Petroleum Equipment, Ltd, 981 Trindle Road West, Mechanicsburg, PA 17055, submitted a Final Report concerning remediation of site soil contaminated with unleaded gasoline. The report is intended to document remediation of the site to meet the Residential Statewide Health Standard.

The Final Report is intended to document remediation of the site to meet the Site Specific standard. Notice of the Final Report was published in the Pittsburgh Post-Gazette on July 25, 2016.

Almono Site (Eliza Furnace & Monongahela Connecting Railroad Parcels), Second Avenue, City of Pittsburgh, Allegheny County. Norfolk Southern Railway Company—New Brighton Former Derailment Site, 1st Avenue and adjacent to 4th Street and 2nd Avenue, Borough of New Brighton, Beaver County. AECOM Technical Services, Inc., 681 Anderson Drive, Foster Plaza, Suite 400, Pittsburgh, PA 15220 on behalf of Norfolk Southern Railway Company, 1200 Peachtree St., NE- Box 13, Atlanta, GA 30309 has submitted a Final Report concerning the remediation of site soils and groundwater contaminated with methanol, benzene, toluene, ethylbenzene, and xylenes from train derailment. The Final Report is intended to document remediation of the site to meet the residential & non-residential Statewide Health standard. Notice of the Final Report was published in the Beaver County Times on February 29, 2016.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Plaza 2331, 2331 East Market Street, York, PA 17402, Springettsbury Township, York County. Independence Environmental Consulting, LLC, 1750 Kaylor Road, Hummelstown, PA 17036, on behalf of Barbara Elliott, 104 South Ogontz Street, York, PA 17403, submitted a Remedial Investigation and Final Report concerning remediation of site soils and groundwater contaminated with VOCs and chlorinated solvents. The Report was disapproved by the Department on August 3, 2016.

Tate Access Floors, Inc., 52 Springvale Road, Red Lion, PA 17356-0398, Windsor Township, York County. Amec Foster Wheeler, 800 North Bell Avenue, Carnegie, PA 15106, on behalf of USG Corporation, P.O. Box 6721, Chicago, IL 60680-6721, submitted a Remedial Investigation and Risk Assessment Report concerning remediation of site soil and groundwater contaminated with chlorinated solvents. The combined report was administratively incomplete and was disapproved by the Department on August 2, 2016.

Southwest Region: Environmental Cleanup & Brown-field Development Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

Bay Valley Foods, 1800 River Avenue, City of Pittsburgh, Allegheny County. Groundwater & Environmental Services, Inc., 301 Commerce Park Drive, Cranberry Twp., PA 16066 on behalf of Bay Valley Foods, LLC, 2021 Spring Road, Suite 600, Oak Brook, IL 60526 submitted a Remedial Investigation Report/Final Report (RIR/FR) addendum concerning the remediation of site soils and groundwater contaminated with volatile & semi-volatile organic compounds and metals. The RIR/FR demonstrated attainment of the Site Specific standard for soil and groundwater and was approved by the Department on August 4, 2016.

(500 Broadway, Hanover, PA 17331) on August 2, 2016, for the modification of the ductwork for the fabric filter which controls emissions from the molding and coring operations at the foundry in Hanover Borough, York County. Upon completion of the proposed modifications, the fabric filter will vent directly to atmosphere.

67-05083F: Calpine Mid-Merit, LLC (500 Delaware Avenue, Suite 600, Wilmington, DE 19801) on August 1, 2016, for the upgrade (Upgrade) of the York Energy Center Block 2 Electricity Generation Project's nominally rated power output capacity from 760 MWs to 830 MWs at its existing electric power generation facility located in Peach Bottom Township, York County. The additional 70 MWs of nominal electricity will be generated from the steam cycle portion of the Block 2 combined cycle (CC) power plant. The Upgrade consists of the following changes to the sources addressed in P.A. No. 67-05083D (issued on June 15, 2015): Increase each combustion turbines (CT) heat recovery steam generator's (HRSG) natural gas (NG)-fired duct burner's maximum rated heat input capacity from 688 mmBTUs/hr to 820 mmBTUs/hr, and the ability to fire each CT's HRSG's duct burner while the CT is firing ultra-low sulfur diesel (ULSD) fuel oil (duct burner firing during CT NG firing is authorized by P.A. No. 67-05083D).

 The York Energy Center Block 2 Electricity Generation Project consists of the following:

 1. Two NG/ULSD fuel oil-fired CC combustion turbines (Source IDs 205 and 206) controlled by a selective catalytic reduction (SCR) system (NOx control) and an oxidation catalyst (CO and VOC control) in series. Dry low NOx technology will also be employed during NG fuel firing. Water injection technology (NOx control) will also be employed during ULSD fuel oil firing;

 2. One NG-fired auxiliary boiler (Source ID 031);

 3. One cooling tower (Source ID 501) controlled by a high efficiency mist eliminator (PM/PM10/PM2.5 control);

 4. NG piping components (Source ID 502);

 5. Circuit breakers (Source ID 503); and

 6. Five NG condensate storage tanks and one ULSD fuel oil storage tank (Source ID 504).

08-00010K: Global Tungsten & Powders Corporation (1 Hawes Street, Towanda, PA 18848) on August 2, 2016, to construct a Niro model DR-300 hard metal grade spray dryer equipped with a 1.3 MMBtu/hr, natural gas-fired burner and for the installation of a Henlex, Inc. model CHE-1000 cyclone and Nomex model DR-300 fabric collector, in series, at its facility in Towanda Borough and North Towanda Township, Bradford County. If the Department determines that the source is constructed and operated in compliance with the plan approval conditions and the specifications of the application for Plan Approval 08-00010K, the terms and conditions of the plan approval will subsequently be incorporated via administrative amendment into State Only (Synthetic Minor) Operating Permit 08-00010 in accordance with 25 Pa. Code § 127.450.

57-00006A: Dwight Lewis Lumber Company (P.O. Box A, Hillsgrove, PA 18619) on August 2, 2016, to construct a 6.04 MMBtu/hr Advanced Engineered Systems (AES) model AES-125-15-WF, underfeed stoker, biomass-fired boiler and for the installation of a Zurn MTSA-9CYT-6 multiple cyclone at their facility located in Hillsgrove Township, Sullivan County. If the Department determines that the sources are constructed and operated in compliance with the plan approval conditions and the specifications of the application for Plan Approval 57-00006A, the applicant will subsequently apply for a State Only Operating Permit in accordance with 25 Pa. Code Subchapter F.

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Transco has applied for a Small Projects-Joint Permit Application to construct, operate and maintain existing gas line along Muncy Creek in Wolf Township, Lycoming County. The project is proposing to conduct maintenance and stabilization activities on two exposed pipelines. The pipelines, Leidy Line ''A'' and ''B,'' are two of four pipelines at this crossing, and have become exposed in the west side of the channel due to increase erosion of the stream bead and bank. Transco is proposing to install a rock arch weir as a grade control structure. In addition, the exposed pipes will be recoated and streambank protection will be added along the western bank.

 The project proposes to have the following impacts:

E18-499. Lock Haven University, 112 Facilities Building, 95 West Fourth Street, Lock Haven, PA 17745. Lock Haven University's Foundation Field, in Woodward Township, Clinton County, ACOE Baltimore District (Lock Haven, PA Quadrangle N: 41° 08` 57.65"; W: -77° 27` 28.16").

 To construct and maintain the following improvements: 1) an underground electrical service from the existing service at the baseball field scoreboard to the site of the new double sided scoreboard; 2) various at-grade concrete pads to provide a stable bases for: an elevated press box, portable shade shelters, a 2-sided score board, a portable press box and portable bleachers; 3) a 41.5 foot long by 12.0 foot wide press box elevated to an elevation of 576.14 feet on eight 6 inch by 6 inch galvanized cross-braced support framing along with a galvanized outside stair case and separated support framing; 4) an at-grade 2 acre gravel parking lot; 5) in-ground placement of four (4) pipes, the tops of which will be 5 inches below grade. These pipes will be used to temporarily secure goal posts during the games. 6) Modification of previously proposed scoreboards and press box to permanent structures with bottom elevations above the critical elevations; 7) Underground electric and data cabling for press box and 4 foot high portable fence chain link fence (800 LF) located between SR 1001 (Farrandsville Rd) and the West Branch of the Susquehanna River and along both sides of Havenview Drive in the left floodplain of the West Branch of the Susquehanna River, which is a WWF (Warm Water Fishery). This permit was issued under Section 105.13(e) ''Small Projects.''

E14-568. Fisher Waterwheel, Daniel B. Fisher, 106 Toy Cow Lane, Aaronsburg, PA 16820. Fisher Water Wheel, in, ACOE Baltimore District (Millheim, PA Quadrangle N: 40.904984°; W: -77.403267).

 To: construct and maintain: 1) a 30-inch wide by 30-inch long by 12-inch high wedge shaped screened water intake, a flow restrictor plate and one full depth clay trench plug located 15 feet downstream of the intake, 2) bury 1,000 linear feet of 12-inch diameter pipe in the right riparian area, to carry water down gradient to a, 3) 10-foot 5-inch diameter water wheel to pump air inside of a 14-foot wide by 14-foot wide by 13-foot deep enclosed concrete building, with 4) a 15-inch discharge pipe buried for 300 feet to a 5) rock outlet apron in the right floodway of an unnamed tributary of Pine Creek. The pumped air will be used instead of electricity to operate farm machinery. This project proposes to permanently impact 5 linear feet of an unnamed tributary of Pine Creek, which is classified as an Exceptional Value Fishery. This permit was issued under Section 105.13(e) ''Small Projects.'' This permit also includes 401 Water Quality Certification.

 Amend Permit No. E04-349 (which authorized the construction and maintenance of: 1) a temporary dock, pumping facilities and three (3) intake structures within the Ohio River; 2) Two (2) permanent, water intake structures within the Ohio River; 3) a 28` diameter concrete caisson, access drive, parking area, and support facilities, within the floodplain of the Ohio River; 4) multiple utility line crossings of several tributaries to the Ohio River; 5) an outfall structure in the Ohio River; 6) an 18" CPP stormwater outfall structure in a UNT to Rag Run; and 7) the placement and maintenance of fill within the 100-year floodplain of the Ohio River), to:

 1. Construct and maintain a 20` diameter, temporary river intake caisson, consisting of sheet piles, on the bank of the Ohio River (WWF, N), to house pumps; and

 2. Construct and maintain a temporary, 24" diameter intake pipe, which will extend 110` into the Ohio River, and will have a passive screen with a slot size of 0.1-inch and an intake velocity of 0.5 fps, to withdraw approximately 2.5 million gallons per day (MGD).

 3. Place rip-rap along left Ohio River bank.

 These temporary structures will be constructed and maintained in place of the previously authorized temporary dock, pumping facilities and three (3) intake structures, in association with the construction of a new surface water treatment facility, to replace the Authority's existing groundwater wells and treatment plant, which serves as a community public water supply. The overall impacts from this project will remain the same, which will cumulatively impact approximately 558` of various watercourses, and is located in and along the Ohio River, approximately 3,420` upstream from where the Beaver Valley Expressway (I-376) crosses over the Ohio River (Beaver, PA USGS 7.5 minute Topographic Quadrangle; Latitude: 40° 40` 51"; Longitude: -80° 19` 7"; Sub-basin: 20G), in Potter Township, Beaver County.  Mitigation for project impacts will occur by enhancing 0.9 acre of existing wetland through a combination of tree/shrub planting and invasive species control at a mitigation site operated by Resource Environmental Solutions (Cambridge Springs PA Quadrangle N: 41°, 50`, 26"; W: 80°, 06`, 23") in Venango Township, Crawford County.

 The project will result in 297 linear feet of temporary stream impacts and 8,026 square feet (0.18 acre) of temporary wetland impacts all for the purpose of installing a natural gas gathering line and associated access roads in Charleston and Covington Township, Tioga County.

 To construct, operate, and maintain:

 (1) A temporary road crossing using timber mats and an 8 inch diameter gas line impacting 158 linear feet of an unnamed tributary to Mill Creek (EV) (Overton, PA Quadrangle 41°33`23"N, 76°35`36"W);
