FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To construct and maintain approximately 60 feet of 4-inch plastic gas main pipe in the roadbed and within the right-of-way of S.R. 0401, Conestoga Road where it crosses above an unnamed tributary to Valley Creek. This crossing is part of the Conestoga Road Gas Utility Line Project.

 The site is located at 209 Conestoga Road between Valley Creek Road and the East Whiteland Township Municipal Building. (Malvern, PA USGS map Lat: 40.050794, Long: -75.555028).

E35-461. Roaring Brook Township, 430 Blue Shutters Road, Roaring Brook, PA 18444, in Roaring Brook Township, Lackawanna County, U.S. Army Corps of Engineers, Baltimore District.

 To maintain an existing single span stone arch bridge with a span of approximately 18 feet and an underclearance of approximately 8 feet. An improved superstructure was constructed and consists of steel girders and a concrete deck on independent abutments placed independently of the arch bridge. The project is located on Smith Road at the intersection of State Route 0307 (Moscow, PA Quadrangle, Latitude: 41°22`27"; Longitude: -75°36`37").

E57-131. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218, Montoursville, PA 17754-0218. S.R. 4008 Section 019, Unnamed Tributary to Elk Creek Bridge Replacement, Elkland Township, Sullivan County, ACOE Baltimore District (Shunk, PA Quadrangle N: 41° 33` 08"; W: -76° 39` 03").

 PA DOT Engineering District 3-0 proposes to replace a single span reinforced concrete slab bridge with a single cell precast concrete box culvert. The existing bridge has a span of 9.50 Ft., a skew of 58 degrees, an under clearance of 6.33 Ft., a low chord of 1,408.203 Ft. and a hydraulic opening of 48.3 Ft2. The proposed box culvert has a span of 18 Ft., a skew of 90 degrees, an under clearance of 5.0 Ft., a low chord of 1,408.38 Ft. and a hydraulic opening of 90 Ft2. The increase in roadway width is beyond the criteria for the General Permit 11. The project will also include R-8 Rip Rap protection on the right and left upstream and downstream banks. The total stream impact from the proposed box culvert and the stream bank protection will be approximately 210 Ft. The project will not impact any jurisdictional wetlands and does not require mitigation. The Unnamed Tributary to Elk Creek is classified as an Exceptional Value Stream (Also Wild Trout) by Title 25, Chapter 93 Water Quality Standards.

Southwest Region: Waterways & Wetlands Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745

E02-1712, Columbia Gas Transmission, LLC, 1700 South MacCorkle Avenue SE, Charleston, WV 25314, North Fayette Township and South Fayette Township, Allegheny County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Abandon, in-place, some segments of the existing 20" diameter bare steel pipe of the Line 1570 gas pipeline;

 2. Construct and maintain multiple utility line stream and wetland crossings within the Millers Run (WWF) and Robinson Run (WWF) watersheds, and a temporary road crossing, in association with the installation of replacement, 20" diameter carbon steel pipe;

 For the purpose of modernizing and replacing existing, aging infrastructure. In Allegheny County, this project will cumulatively impact approximately 2,241 linear feet (lf) of watercourse and 0.48 acre of wetland. Construction activities will occur within a 75`—100` right-of-way (ROW); however, a 50` permanent ROW will be maintained, post construction. Within Allegheny County, this project begins approximately 1,360` west of the intersection between Reissing Road and Cecil Reissing Road (Canonsburg, PA USGS topographic quadrangle; Latitude: 40° 21` 9.72"; Longitude: -80° 12` 14.42"), in South Fayette Township, Allegheny County, and ends near the intersection of North Branch Road and Third Ave (Oakdale, PA USGS topographic quadrangle; Latitude: 40° 24` 45.58"; Longitude: -80° 12` 33.42"), in North Fayette Township, Allegheny County. This application is for a portion of a multi-county project that is located within Allegheny County; however, the overall project includes the replacement of approximately 34 miles of pipeline, within three (3) pipeline segments, in Allegheny, Greene and Washington Counties.

E02-1718, Sunoco Pipeline, L.P., 535 Fritztown Road, Sinking Spring, PA 19608, Forward Township and Elizabeth Township, Allegheny County, ACOE Pittsburgh District.

 The applicant is proposing to construct, operate and maintain three (3) wetland utility line crossings, twenty eight (28) utility line stream crossings and thirty (30) temporary road crossings, in, across or along watercourses within the Bunola Run (WWF), Sunfish Run (WWF), Monongahela River (WWF), Kelly Run (WWF), Pollock Run (WWF), Long Hollow (WWF), Mill Run (WWF), Beckets Run (WWF), and Gillespie Run (WWF) watersheds. The project is located in Forward, and Elizabeth Townships, in Allegheny County, starting at a crossing of the Monongahela River, approximately two miles downstream from the town of New Eagle, Pennsylvania (Start: USGS Monongahela Quadrangle, Latitude: 40°13`48", Longitude: -79°48`18"), and exiting the county approximately 0.25 mile north of the intersection of Salem Church Road and SR 136 (End: USGS Donora Quadrangle, Latitude: 40°13`10", Longitude: -79°48`18"). This project is a portion of a larger project that will construct two parallel natural gas liquid pipelines, within multiple counties, across the Commonwealth, for the purpose of interconnecting the existing SPLP Mariner East pipelines, over a 306-mile, 50-foot-wide right-of-way (ROW), from Houston, Washington County, Pennsylvania to Sunoco Pipeline, L.P.'s (SPLP) Marcus Hook facility in Delaware County, Pennsylvania. The portion of this project within Allegheny County will cumulatively and permanently impact 0.361 acre of PEM wetlands and 1,476 feet of watercourses.

 The applicant is proposing to construct, operate and maintain eighty eight (88) wetland utility line crossings, one hundred sixty two (162) utility line stream crossings and two hundred forty (240) temporary road crossings, in, across or along the watercourses within the Stewart Run (HQ-CWF, CWF), Burgoon Run (CWF), Hinckston Run (CWF), Roaring Run (CWF), Saltlick Run (HQ-CWF), North Branch (CWF), Little Conemaugh River (CWF), Laurel Run, (HQ-CWF), Findley Run (HQ-CWF), Bear Rock Run (CWF), Blair Run (CWF), Howells Run (CWF), and Noels Creek (HQ-CWF) watersheds. The project is located in Jackson, Cambria, Washington, Munster, Cresson Townships in Cambria County, starting approximately two miles northeast of the intersection of SR 711 and SR 403 (Start: USGS Vintondale Quadrangle, Latitude: 40°25`46", Long: -78°57`16"), and exit the county approximately one mile north of the intersection of Mountain Road and Lily Mountain Road (End: USGS Cresson Quadrangle, Latitude: 40°24`30", Longitude: -78°33`25"). This project is a portion of a larger project that will construct two parallel natural gas liquid pipelines, within multiple counties, across the Commonwealth, for the purpose of interconnecting the existing SPLP Mariner East pipelines, over a 306-mile, 50-foot-wide right-of-way (ROW), from Houston, Washington County, Pennsylvania to Sunoco Pipeline, L.P.'s (SPLP) Marcus Hook facility in Delaware County, Pennsylvania. The portion of this project within Cambria County will cumulatively and permanently impact 4.491 acres of PEM, PSS, and PFO wetlands and 6,043 feet of watercourses. In addition, this project will temporarily impact 0.411 acre of PEM wetlands and 286 feet of watercourses.

E30-248, Columbia Gas Transmission, LLC, 1700 South MacCorkle Avenue SE, Charleston, WV 25314; Center Township, Franklin Township, Gilmore Township and Wayne Township; Greene County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Abandon, in-place, some segments of the existing 20" diameter bare steel pipe of the Line 1570 gas pipeline;

 2. Construct and maintain multiple utility line stream and wetland crossings within the PA Fork Dunkard Creek (WWF), Dunkard Creek (WWF), and South Fork Tenmile Creek (HQ-WWF) watersheds, in association with the installation of replacement, 20" diameter carbon steel pipe; and

 3. Construct and maintain fifteen (15) temporary road crossings, including timber mat crossings;

 For the purpose of modernizing and replacing existing, aging infrastructure. In Greene County, this project will cumulatively impact approximately 4,621 linear feet (lf) of watercourse and 2.14 acres of wetland. Construction activities will occur within a 75`—100` right-of-way (ROW); however, a 50` permanent ROW will be maintained, post construction. Within Greene County, this project begins approximately 0.25 mile south of the intersection between Hagan Creek Road and Hero Road (Wadestown, W.VA-PA USGS topographic quadrangle; Latitude: 39° 43` 17.45"; Long: -80° 21` 0.48"), in Gilmore Township, Greene County, through Center and Wayne Townships (Holbrook, PA and Oak Forest, PA USGS topographic quadrangles), and ends approximately 0.32 mile East of where S.R. 18 crosses over South Fork Tenmile Creek (Waynesburg, PA USGS topographic quadrangle; Latitude: 39° 53` 45.27"; Longitude: -80° 13` 2.0"), in Franklin Township, Greene County. This application is for a portion of a multi-county project that is located within Greene County; however, the overall project includes the replacement of approximately 34 miles of pipeline, within three (3) pipeline segments, in Allegheny, Greene and Washington Counties.

E32-508, Sunoco Pipeline, L.P., 535 Fritztown Road, Sinking Spring, PA 19608, Burrell Township, West Wheatfield Township, and East Wheatfield Township; Indiana County, ACOE Pittsburgh District.

 The applicant is proposing to construct, operate and maintain fifty (50) wetland utility line crossings, one hundred four (104) utility line stream crossings and one hundred forty one (141) temporary road crossings, in, across or along watercourses within the Conemaugh River (HQ-CWF, TSF, CWF, WWF), West Branch (CWF), Toms Run (CWF), Blacklick Creek (CWF), East Branch (CWF), Findley Run (HQ-CWF), Hedges Lakes (CWF), and Roaring Run watersheds. The project is located in Burrell, West Wheatfield, and East Wheatfield Townships, in Indiana County, starting at a crossing of the Conemaugh River, approximately two miles downstream from U.S. 119N (End: USGS Blairsville Quadrangle, Latitude: 40°26`43", Longitude: -79°18`00"), and exit the county approximately one mile to the northeast of Findley Run Reservoir (End: USGS Vintondale Quadrangle, Latitude: 40°25`46" Longitude: -78°57`16"). This project is a portion of a larger project that will construct two parallel natural gas liquid pipelines, within multiple counties, across the Commonwealth, for the purpose of interconnecting the existing SPLP Mariner East pipelines, over a 306-mile, 50-foot-wide right-of-way (ROW), from Houston, Washington County, Pennsylvania to Sunoco Pipeline, L.P.'s (SPLP) Marcus Hook facility in Delaware County, Pennsylvania. The portion of this project within Indiana County will cumulatively and permanently impact 1.383 acre of PEM, PSS, and PFO wetlands and 4,357 feet of watercourses. In addition, this project will temporarily impact 0.027 acre of PEM wetlands and 169 feet of watercourses.

E63-668, Columbia Gas Transmission, LLC, 1700 South MacCorkle Avenue SE, Charleston, WV 25314; Canonsburg Borough, Houston Borough, Amwell Township, Cecil Township, Chartiers Township, North Strabane Township and South Strabane Township; Washington County, ACOE Pittsburgh District.

 The applicant is proposing to:

 1. Abandon, in-place, some segments of the existing 20" diameter bare steel pipe of the Line 1570 gas pipeline;

 2. Construct and maintain multiple utility line stream and wetland crossings within the Little Chartiers Creek (HQ-WWF), Chartiers Creek, main stem and unnamed tributaries (WWF), Brush Run (WWF) and Millers Run (WWF) watersheds, in association with the installation of replacement, 20" diameter carbon steel pipe; and

 3. Construct and maintain nineteen (19) temporary road crossings, including timber mat crossings;

 For the purpose of modernizing and replacing existing, aging infrastructure. In Washington County, this project will cumulatively impact approximately 3,863 linear feet (lf) of watercourse and 5.39 acres of wetland. Construction activities will occur within a 75`—100` right-of-way (ROW); however, a 50` permanent ROW will be maintained, post construction. Within Washington County, this project begins near the interchange between S.R. 40 and I-79 (Washington East, PA USGS topographic quadrangle; Latitude: 40° 8` 53.01"; Longitude: -80° 12` 11.92"), in Amwell Township, Washington County, and continues, in discontinuous segments, through Canonsburg and Houston Boroughs, and Chartiers, North Strabane and South Strabane Townships, until a point that is approximately 0.5 mile NW of the intersection between Reissing Road and Cecil Reissing Road (Canonsburg, PA USGS topographic quadrangle; Latitude: 40° 20` 59.51"; Longitude: -80° 12` 14.91"), in Cecil Township, Washington County. This application is for a portion of a multi-county project that is located within Washington County; however, the overall project includes the replacement of approximately 34 miles of pipeline, within three (3) pipeline segments, in Allegheny, Greene and Washington Counties.

E63-674, Sunoco Pipeline, L.P., 535 Fritztown Road, Sinking Spring, PA 19608, Chartiers Township, North Strabane Township, Nottingham Township, and Union Township; Washington County, ACOE Pittsburgh District.

 The applicant is proposing to construct, operate and maintain eleven (11) wetland utility line crossings, fifty one (51) utility line stream crossings and fifty four (54) temporary road crossings, in, across or along the watercourses within the Chartiers Run (WWF), Chartiers Creek (WWF), Little Chartiers Creek (HQ-WWF), Mingo Creek (HQ-TSF), Froman Run (TSF), (TSF), and Peters Creek (TSF) watersheds. The project is located in Chartiers, North Strabane, Nottingham, and Union Townships, in Washington County, starting at a point located approximately 2,000 feet west of the intersection of Ullom Road and S.R. 519 (Start: USGS Midway Quadrangle, Latitude: 40°15`41", Longitude: -80°16`1"), and exiting the county at a crossing of the Monongahela River, approximately two miles downstream from the town of New Eagle, Pennsylvania (End: USGS Hackett Quadrangle, Latitude: 40°13`48", Longitude: -79°58`15"). This project is a portion of a larger project that will construct two parallel natural gas liquid pipelines, within multiple counties, across the Commonwealth, for the purpose of interconnecting the existing SPLP Mariner East pipelines, over a 306-mile, 50-foot-wide right-of-way (ROW), from Houston, Washington County, Pennsylvania to Sunoco Pipeline, L.P.'s (SPLP) Marcus Hook facility in Delaware County, Pennsylvania. The portion of this project within Washington County will cumulatively and permanently impact 0.248 acre of PEM wetlands and 1,886 feet of watercourses. In addition, this project will temporarily impact 0.048 acre of PEM wetlands and 68 feet of watercourses.

 The applicant is proposing to construct, operate and maintain sixty two (62) wetland utility line crossings, one hundred forty eight (148) utility line stream crossings and one hundred ninety six (196) temporary road crossings, in, across or along the watercourses within the Pollock Run (WWF), Little Sewickley Creek (WWF/HQ-WWF), Brush Creek (WWF/TSF), Bushy Run (TSF), Turtle Creek (TSF), Sewickley Creek (WWF/TSF), Beaver Run (HQ-CWF), Porters Run (HQ-CWF), Spruce Run (HQ-CWF), Boatyard Run (CWF/WWF), Youghiogheny River (WWF), Serviceberry Run (HQ-WWF), Kelly Run (WWF), Loyalhanna Creek (WWF), Conemaugh River (WWF/HQ-CWF), and Loyalhanna Lake (WWF/HQ-WWF) watersheds. The project is located in Rostraver, South Huntingdon, Sewickley, Hempfield, Derry, Penn, Salem, and Loyalhanna Townships, the City of Jeanette, and Murrysville Borough, in Westmoreland County, starting at a point approximately 1,500 feet northwest of the intersection of Salem Church Road and S.R. 136 (Start: USGS Donora Quadrangle, Latitude: 40°13`10", Longitude: -79°48`18", and exiting the county at a crossing of the Conemaugh River, approximately two miles downstream from U.S. 119N (End: USGS Blairsville Quadrangle, Latitude: 40°26`43", Longitude: -79°18`00"). This project is a portion of a larger project that will construct two parallel natural gas liquid pipelines, within multiple counties, across the Commonwealth, for the purpose of interconnecting the existing SPLP Mariner East pipelines, over a 306-mile, 50-foot-wide right-of-way (ROW), from Houston, Washington County, Pennsylvania to Sunoco Pipeline, L.P.'s (SPLP) Marcus Hook facility in Delaware County, Pennsylvania.  The Department has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and NOIs for coverage under General Permits. This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1—691.101) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania AT&T Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.
