FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevantState requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To (1) extend and maintain existing stream enclosure 237-linear feet with a 36-inch diameter with R-5 riprap apron for scour protection and within an Unnamed Tributary to Brush Run which is a perianal stream classified as a Warm Water Fishery, (2) place fill in 0.03 acre of Exceptional Value (EV) Palustrine Emergent (PEM) wetland, (3) place fill in 0.13 acre of EV PEM/Palustrine Scrub Shrub (PSS) wetland and temporarily impacting 0.13 acre of this wetland, (4) temporarily impact 0.01 acre of EV PSS wetland, and (5) construct .82 acre of wetlands as compensation for wetland Impacts permanently impacting 0.01 acre of existing EV PEM wetland. The project proposes to directly affect a total of 237-linear feet of stream channel, temporarily impact 0.14 acre of Exceptional Value Wetland and permanently impact 0.17 acre of Exceptional Value Wetland, and proposes to create 0.46 acre of wetland as compensatory mitigation.

E01-307: Liberty Mountain Resorts, 78 Country Club Trail, Carroll Valley, PA 17320 in Carroll Valley Borough, Adams County, ACOE Baltimore District

 To place and maintain fill in 0.10-acre of a pond for the purpose of expanding a commercial facility and improve transportation safety. The project is located at the intersection of Sanders Road and Country Club Trail. (Iron Springs, PA Quadrangle N: Latitude: 39°45`54.4", Longitude: 77°22`22"), in Carroll Valley Borough, Adams County.

E67-911: Springettsbury Township, 1501 Mt. Zion Road, York, PA 17402, Springettsbury Township, York County, ACOE Baltimore District

 To (1) remove the existing structure and to install and maintain a 48.0-inch sanitary sewer line in and across Mill Creek and its floodway (WWF, MF), an unnamed tributary to Mill Creek (WWF, MF) and associated wetlands; (2) to improve and maintain an existing 6.0-foot X 30.0-foot temporary ford crossing in Mill Creek (WWF, MF) all for the purpose of improving traffic safety. The project is located at Mount Rose Avenue, Exit 18, of interstate 83 (York, PA Quadrangle, Latitude: 39°57`26"N, Longitude: 76°41`10.4"W) in Springettsbury Township, York County.

E67-910: Gregory J. Myers, 110 Miller Road, York Haven, PA 17370, Newberry Township, York County, ACOE Baltimore District

 To construct and maintain a single span bridge having a normal span of 60.0 feet, a width of 14.0 feet and an underclearance of 5.0 feet across Bennett Run (WWF, MF) for the purpose of providing access to private residences. The project is located on the west side of Miller Road south of its intersection with Lewisberry Road (Steelton, PA Quadrangle, Latitude: 40°07`42"N, Longitude: 76°49`41.7"W) in Newberry Township, York County.

E01-307: Liberty Mountain Resorts, 78 Country Club Trail, Carroll Valley, PA 17320, Carroll Valley Borough, Adams County, ACOE Baltimore District

 The applicant proposes to place and maintain fill in 0.10-acre of a pond for the purpose of expanding a commercial facility and improve transportation safety. The project is located at the intersection of Sanders Road and Country Club Trail.  The applicant is proposing to remove existing structures and to place and maintain fill in the floodway of Painters Run (WWF); this project is in association with the construction of a new one-story, 11,000 square foot building, located at 631 Painters Run Road (USGS Bridgeville, PA Quadrangle; N: 20.33 inches; W: 9.36 inches; Latitude: 40° 21` 43"; Longitude: -80° 4` 2"), in Upper St. Clair Township, Allegheny County.

E02-1695. PennDOT District 11-0, 45 Thoms Run Road Bridgeville, PA 15017; City of Pittsburgh, Allegheny County; ACOE Pittsburgh District.

 The applicant is proposing to do the following:

 1. Fill the existing 896 ft long upper portion of the SR 885, Mifflin Road, 12.0 ft wide, 6.5 ft under clearance box culvert; construct and maintain a relocated 950 ft long by 10 ft to 60 ft wide open channel to an unnamed tributary to Streets Run (WWF) with a drainage area of 1.2 square miles;

 2. Construct and maintain a 12 ft wide 175 ft long by 6.5 ft under clearance box culvert replacement under the Slate Street intersection of the existing upper most 100 ft portion of the above noted Mifflin Road box culvert, with a drainage area of 1.2 square miles;

 3. Construct and maintain a 12 ft wide 100 ft long by 6.5 ft under clearance box culvert replacement of the existing lower 175 ft portion of the above noted Mifflin Road box culvert, with a drainage area of 1.2 square miles;

 4. Construct and maintain a 14 ft wide 60 ft long by 5.5 foot underclearance box culvert replacement of the existing 14 ft span 53 ft long 5 ft under clearance concrete slab bridge on Mifflin Road, with a drainage area of 1.2 square miles;

 5. Construct and maintain a 10 ft wide 89 ft long by 4 foot underclearance box culvert replacement of the existing 10 ft wide 89 ft long 3.6 ft clearance box culvert under Mifflin Road, with a drainage area of 0.58 square mile;

 6. Construct and maintain a 9 ft wide 119 ft long by 4 foot underclearance box culvert replacement of the existing 9 ft wide 138 ft long 3.7 ft clearance box culvert under Lebanon Road, with a drainage area of 0.42 square mile;

 7. In addition install and maintain road associated stormwater outfalls; install and remove temporary encroachments for construction; and provide onsite stream mitigation.

 This project is associated with the SR 885 improvement work with the project extending approximately 0.25 mile north of the Lebanon Road and Mifflin Road intersection in the City of Pittsburgh, Allegheny County (Pittsburgh East PA Quadrangle, North 1.5 inches and West 7.7 inches; Latitude 40° 23' and Longitude -79° 55` 50"; to North 0.8 inches and West 7.0 inches; Latitude 40° 22` 46" and Longitude -79° 55` 32").

E65-958. Municipal Authority of Westmoreland County, 124 Park & Pool Road, New Stanton, PA 15672; South Greensburg Borough and Hempfield Township, Westmoreland County; ACOE Pittsburgh District.

 The applicant is proposing to construct, operate and maintain two 48" waterline stream crossings across Jacks Run and an unnamed tributary to Jacks Run (WWF). As a result of this project, approximately 78 LF of stream will be impacted. The project is located along Shady Lane, Broadway Avenue and Keystone Street (Greensburg, PA Quadrangle N: 4.0 inches; W: 7.4 inches, Latitude: 40° 15` 27"; Longitude: 79° 33` 23"), in South Greensburg Borough and Hempfield Township, Westmoreland County.

E65-959. Municipal Authority of Westmoreland County, 124 Park & Pool Road, New Stanton, PA 15672; New Stanton Borough and Hempfield Township, Westmoreland County; ACOE Pittsburgh District.

 The applicant is proposing to construct, operate and maintain two 48" waterline stream crossings across an unnamed tributary to Sewickley Creek (WWF). As a result of this project, approximately 60 LF of stream and 16,250 SF of wetland will be impacted. The project is located along Center Avenue, and will cross over Bridge Street, Sandworks Road, Sunny Lane, and Corporate Road (Mount Pleasant, PA Quadrangle N: 13.25 inches; W: 14.25 inches, Latitude: 40° 11` 25"; Longitude: 79° 35` 34"), in New Stanton Borough and Hempfield Township, Westmoreland County.

E65-962. Edith Shapira, 6550 Beacon Street, Pittsburgh, PA 15217-1843; Fairfield Township, Westmoreland County; ACOE Pittsburgh District.

 The applicant is proposing to excavate in the floodway of an unnamed tributary to Snyders Run (TSF), to construct and maintain a non-jurisdictional dam across this unnamed tributary and along the floodway of Snyders Run (TSF), with outlet works along Snyders Run, and to construct and maintain an intake structure and a j-hook in Snyders Run, for the purpose of enlarging an existing, approximately 0.2 acre pond, into an approximately 2.0 acre pond. In total, the project will impact approximately 217.5' of watercourse. Two (2) boat and fishing docks will be installed within the enlarged pond. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.
