FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not, in and of itself, create a right of appeal beyond that permitted by applicable statutes and decisional law.

 The issuance of this permit also constitutes approval of a Water Quality Certification under Section 401 of the Federal Water Pollution Control Act [33 U.S.C.A. 1341(a)].

 To construct and maintain the following water obstructions and encroachments associated with the Askam Borehole Acid Mine Discharge Remediation Project:

 1. To construct and maintain an on-stream AMD settling pond having a surface area of approximately 1.33 acres and a depth of 10 feet in Nanticoke Creek, with a high-volume aeration/oxidizing unit at the pond inlet.

 2. To construct and maintain a 570-foot long ''high-flow'' riprap-lined trapezoidal bypass channel around the settling pond, having an 18-foot bottom width and 1.5 to 1 side slopes.

 3. To construct and maintain a 200-L.F., 30-inch diameter concrete pipe and a 40-L.F., 24-inch diameter concrete pipe connecting the two Askam Borehole discharge locations to the on-stream settling pond.

 The project will impact approximately 1.6 acres of wetlands and 800 feet of stream channel.

 The project is located on the west side of Dundee Road immediately north of the S.R. 0029 Overpass (Wilkes-Barre West, PA Quadrangle Latitude: 41° 12` 01"; Longitude: -75° 57` 58"). Subbasin: 5B

E54-325. Blythe Township, P.O. Box 91, Combola, PA 17931. Blythe Township, Schuylkill County, Army Corps of Engineers Philadelphia District.

 To relocate and reestablish the ''historic'' Little Wolf Creek (CWF) with the construction and maintenance of 6,700 feet of riprap-lined trapezoidal channel and a 1,600-foot long, 42-inch diameter HDPE stream enclosure; and to place fill in 0.3 acre of isolated wetlands. The encroachments are associated with the proposed construction and demolition waste landfill known as the Blythe Recycling and Demolition Site (BRADS). The permittee is required to provide for 0.3 acre of replacement wetlands by participating in the Pennsylvania Wetland Replacement Project. The project is located on the north SR 1006 (Burma Road), approximately 2.3 miles east of St. Clair (Pottsville, PA Quadrangle Latitude: 40° 44` 23"; Longitude: -76° 09` 22") in Blythe Township, Schuylkill County. Subbasin: 3A

E54-354. Eagle Rock Co., 1 Country Club Road, Hazle Township, PA 18202 in East Union Township, Schuylkill County, Army Corps of Engineers Baltimore District.

 To construct and maintain a road crossing of Little Tomhicken Creek (CWF) consisting of an open-bottom structural plate arch culvert having a span of 20`-8" and an underclearance of 5`-2" with upstream and downstream ends mitered to slope and protected with riprap. The purpose of the road crossing is to provide access to the Eagle Rock Resort, Hidden Forest Residential Subdivision, Phase 2. This permit also authorizes the construction and maintenance of a rip rap lined stormwater outfall channel in the floodway of Little Crooked Run (HQ-CWF, MF). The project is located on the west side of SR 1005 (Nuremberg Road) approximately 0.4 mile north of its intersection with Cove Mountain Drive (Nuremberg, PA Quadrangle Latitude: 40° 54` 30"; Longitude: -76° 08` 23"). E07-439: Duncansville Borough, PO Box 308, Duncansville, PA 16635 in Duncansville Borough and Allegheny Township, Blair County, ACOE Baltimore District

 To install and maintain 2 rock deflectors, 3 rock cross vanes, 344 linear feet of rip rap protection, 935 feet of rip rap bank toe protection, re-grade and re-vegetate 785 linear feet of streambank to a 3:1 slope, remove 435 linear feet of gravel bar, and relocate 190 linear feet of stream channel, all in and along Gillans Run (CWF, MF) for the purpose of streambank stabilization and stream restoration. The project is located along or near the northern municipal limits of Duncansville Borough and adjacent areas of Allegheny Township, Blair County (Hollidaysburg, PA Quadrangle N: 9.0 inches, W: 7.6 inches: Latitude: 40°25`28.5", Longitude: - 78°25`46.7").

E22-575: Pennsylvania Turnpike Commission, PO Box 67676, Harrisburg, PA 17106 in Londonderry and Lower Swatara Townships, and Middletown Borough in Dauphin County, ACOE Baltimore District

 To place and maintain fill in 0.46 acre of Palustrine Emergent/Palustrine Scrub Shrub/Palustrine forested wetlands; 2) relocate and maintain 553.0 feet of an unnamed tributary to Swatara Creek (WWF, MF); 3) relocate and maintain 314.0 feet of an unnamed tributary to Swatara Creek (WWF, MF); 4) construct and maintain a 75.0-foot long, 18.0-inch RCCP pipe conveying an unnamed tributary to Swatara Creek (WWF, MF); 5) construct and maintain an 83.0-foot long 54.0-inch diameter RCCP culvert extension in an unnamed tributary to Swatara Creek (WWF, MF); 6) install and maintain two 30.0-foot long, 24.0-inch diameter RCP pipes with rip rap apron in an unnamed tributary to Swatara Creek (WWF, MF); 7) construct and maintain a 125.5-foot wide, 610.0-foot long four span continuous bridge with a multiple welded plate girder superstructure, composite concrete decking, and three solid wall type piers in Swatara Creek (WWF, MF); 8) install and maintain a 631.0-foot long temporary construction causeway in Swatara Creek (WWF, MF), all for the purpose of increasing traffic capacity. This project will permanently impact 1,229 linear feet of streams and 0.50 acre of wetlands, and temporarily affect 704 linear feet of streams and 0.03 acre of wetlands. The project is located between MP 250 and MP 252 (Latitude: 40°12`40.3"; Longitude: -76°43`13.3") in Londonderry and Lower Swatara Townships, Dauphin County.

 To 1) cut, fill and maintain new topography in the 100-year floodplain area for stream crossings, roadways, utilities, storm drains, floodplain benching and to raise the proposed building pad elevations 1.5 feet above the 100-year flood elevation with a net loss in floodplain fill, 2) construct and maintain new single span 35-foot 9-inch by 7-foot 9-inch galvanized steel arch over Limestone Run at the North 10th Street to serve as the primary entrance to the development and includes filling 0.018 acre of intermittent stream, 3) to remove of the existing steel bridge and low-head concrete dam, followed by the construction and maintenance of a 60-foot long by single span 35-foot 9-inch by 7-foot 9-inch galvanized steel arch over Limestone Run Bridge Crossing at the North 11th Street, 4) remove a 87.57 linear foot existing corrugated metal pipe stream enclosure, fill 0.157 acre of the isolated sections of the intermittent stream, then construct and maintain 594 linear feet of new stream channel to convey the upslope runoff through the site and allow for the construction of the main access street through the site, 5) fill 0.012 acre of wetlands, construct and maintain 120 linear feet of 81-inch wide by 59-inch high spiral rib pipe arch enclosure to convey the flows of the existing intermittent stream to the constructed stream for the access street crossing, 6) removal of the Peking Garden restaurant building and support piers that sit over/in the stream, 7) removal of the old railroad piers located a few feet west of the restaurant, 8) replace an existing sanitary sewer main under Limestone Run, 9) filling 0.62 acre of wetlands, 10) implementation of a eel stocking program to mitigate for the stream impacts, 11) construct 0.995 acre of replacement wetlands on site (Lewisburg, PA Quadrangle N: 40° 57` 42"; W: -76° 54` 07") in East Buffalo Township, Union County. This permit also includes 401 Water Quality Certification.

 Applicant has been given consent to operate and maintain the existing barge mooring facility, originally approved under permit E0275723, approximately 522.0 linear feet in length and 128.0 feet in width (as measured from the normal pool elevation) in the channel and along the left bank of the Ohio River (WWF-N), to dredge and maintain the channel along the left bank of said stream for a distance of approximately 482.0 linear feet and 50.5 feet in width (average), to replace the existing pipe rack and wiring attached to the existing walkway, to replace the existing dock winch and to construct and maintain a shelter at the end of the existing walkway in the channel of said stream for the purpose of improving the existing barge mooring facility.  The project will result in 150 linear feet or 1,373 square feet of temporary stream impacts and 39,737 square feet (0.91 acre) of PEM and PSS wetlands and 9,197 square feet (0.21 acre) of permanent conversion of a PFO wetland all for the purpose of installing a natural gas pipeline with associated access roadways for Marcellus shale development in Wilmot Township, Bradford County.  The project consists of constructing approximately 3.56 miles of 12" natural gas gathering line from the Zick Well Pad routed in a northerly direction to the Stalter Pipeline in Lenox Township, Susquehanna County. The project will result in 600 lineal feet of stream impacts and 1.05 acres of wetland impact, of which 0.94 acre are permanent wetland conversion impacts, all for the purpose of conveying Marcellus Shale natural gas to market. Mitigation will be provided off site at the North Branch Land Trust site (Howland Mitigation Area) located in Washington Township, Wyoming County. The mitigation site will create 0.94 acre of new PSS and PFO wetlands and provide 0.12 acre of enhancement of two existing PEM wetlands by plantings.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be send to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed which the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not in and of itself create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
