FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 The Cobbs Creek Watershed Improvement Project is located at the confluence of the East and West branches of Indian Creek (WWF, MF). Flow of the West Branch will be diverted from an existing culvert to a created natural stream channel. Bank stabilization, restoration of a riparian buffer and debris removal will be conducted. A combined sewer outfall (CSO) will be directed to a temporary storage created from the existing culvert. Specific water obstruction and encroachment activities consist of:

 1) To create and maintain approximately 1,300 linear feet of stream channel with an approximate width of 40 feet to convey the West Branch. This work includes creation of forested riparian buffers, habitat improvement measures and temporary access roads in and along the new channel.

 2) To remove approximately 700 linear feet of the existing brick culvert.

 3) To reconstruct and maintain the existing CSO outfall structure within the footprint of the existing brick culvert to serve as temporary storage for CSO discharges.

 4) To stabilize and maintain the channel and banks of the existing branches. All disturbed areas will be stabilized and replanted with native plants.

 The site is located approximately 1,000 feet northeast of the intersection of Haverford Avenue and Lansdowne Avenue (Lansdowne, PA USGS Quadrangle N: 18.01 inches; W: 1.52 inches).

E18-476. John K. & Lydia L. Fisher, 18 Embick Lane. Fisher Property, in Greene Township, Clinton County, ACOE Baltimore District (Loganton, PA Quadrangle N: 41°1`20.6"; W: -77° 18` 40.3").

 To construct and maintain: 1) a rock armored screened water intake, 2) 175 feet of 12-inch buried pipe and 3) a 54-inch diameter overshot metal water wheel and associated riprap apron next to a wetland overflow area, 4) to run an air compressor with tank in the left 100-year floodplain of Fishing Creek. The water wheel will generate compressed air to power the well pump and water supply to an Amish chicken house. Electricity will not be generated with this system. All water will be returned to Fishing Creek after flowing through the water wheel system. This project proposes to impact 10 linear of Fishing Creek, which is classified as High Quality, and no direct impacts to riparian wetlands.

Southwest Region: Wetlands & Waterways Program Manager, 400 Waterfront Drive, Pittsburgh, PA 15222-4745.

E32-490-A2. EME Homer City Generation, L.P., 1750 Power Plant Road, Homer City, PA 15748-9558, Blacklick & Center Townships, Indiana County; ACOE Pittsburgh District.

 Applicant is proposing to place and maintain fill in 0.10 acre of wetlands, and temporarily impact 0.072 acre of wetlands in the Two Lick Creek watershed (CWF) for the purpose of constructing a rail line associated with a new Flue Gas Desulfurization system. The project is located in Center Township, Indiana County, PA (Indiana, PA quadrangle, N 1.75", W 10.75"; latitude 40° 30` 53.4", longitude -79° 11` 58.9"). For mitigation, the applicant proposes to construct an off-site PEM wetland mitigation area along an unnamed tributary to Cherry Run (CWF) to include 0.52 acre of PEM wetlands (Indiana, PA Quadrangle, N 5.87", W 11.25"; latitude 40° 31` 54.9", longitude -79° 12` 13"). The previous permit, issued on February 1, 2012, and amended on May 7, 2012, authorized the placement of fill in 0.169 acre of wetlands in the Blacklick Creek, Muddy Creek, and Two Lick Creek Basins (CWF) for the purpose of expanding a waste disposal area, and constructing a storm water management pond for a new Flue Gas Desulfurization system. In addition, the construction of a concrete lined diversion channel (DC-37) and the placement of fill from leachate pond L-1 within the floodway of an unnamed tributary to Blacklick Creek (CWF) (D.A.<100 acres) was authorized. The project is located in Blacklick and Center Townships, Indiana County (Indiana, Pa Quadrangle North 4.7", West 12.0"; Latitude 40 31` 12" Longitude 79 12` 39"). To mitigate for these impacts, a 0.169 acre wetland replacement site was constructed off-site along an unnamed tributary to Cherry Run (CWF). (Indiana, PA Quadrangle N 5.6"; W 11.5"; Latitude 40° 31` 50" Longitude 79° 12`29").

E43-357, PA DOT District 1-0, 255 Elm Str., Oil City, PA 16301. SR 0019 Section B04 Iron Bridge Replacement, in Springfield Township, Mercer County, ACOE Pittsburgh District (Mercer, PA Quadrangle N: 41°, 09`, 27.5"; W: -80°, 13`, 33.2").

 To remove the existing single span steel through truss bridge and to construct and maintain on a new alignment 33 feet upstream of existing structure a 141 foot single clear span composite steel girder bridge over Neshannock Creek (TSF) along Perry Highway, Springfield Township, SR 0019 Segment 0060 Offset 0000 approximately 1 mile North of its intersection with SR 2002 Leesburg Station Road. Project also includes placement 0.044 acre of fill in a Palustrine Emergent Wetland (PEM), 2,400 foot realignment of SR 0019 and reconstruction and realignment of SR 0019 and Smith and Creek Road intersections.

 To construct, operate, and maintain:

 1) two 6 inch gas lines, two 6 inch water lines, one 12 inch water line, electric/fiber optic line, and a timber mat crossing impacting 114 linear feet of an unnamed tributary to Stony Gap Run (HQ-CWF, MF) and 1,138 square feet of palustrine emergent (PEM) wetland (Salladasburg, PA Quadrangle 41°18`34"N 77°08`41"W);

 2) two 6 inch gas lines, two 6 inch water lines, one 12 inch water line, electric/fiber optic line, and a timber mat crossing impacting 61 linear feet of an unnamed tributary to Stony Gap Run (HQ-CWF, MF) and 10,488 square feet of adjacent palustrine emergent (PEM) and palustrine scrub-shrub (PSS) wetlands (Salladasburg, PA Quadrangle 41°18`38"N 77°08`51"W);

 3) two 6 inch gas lines, two 6 inch water lines, one 12 inch water line, electric/fiber optic line, and a timber mat crossing impacting 84 linear feet of an unnamed tributary to Stony Gap Run (HQ-CWF, MF) and 18,003 square feet of adjacent palustrine emergent (PEM) and palustrine scrub-shrub (PSS) wetlands (Salladasburg, PA Quadrangle 41°19`12"N 77°09`10"W).

 The project will result in 259 linear feet of temporary stream impacts and 0.68 acre of temporary wetland impacts all for the purpose of installing natural gas and freshwater pipelines with associated roadways for Marcellus well development.

E5729-037: Appalachia Midstream Services, LLC, 100 IST Center, Horseheads, New York, 14845, Fox Township, Sullivan County, USACE Baltimore District. To construct, operate, and maintain:

 (1) A temporary road crossing using a wood mat bridge and a 16 inch diameter gathering line impacting 192 linear feet of an unnamed tributary to Fall Run (EV) (Grover, PA Quadrangle 41°32`20"N, 76°45`16"W);

 (2) A temporary road crossing using a timber mats and a 16 inch diameter gathering line impacting 5,389 square feet of an exceptional value palustrine emergent/scrub-shrub (EV-PEM/PSS) wetland (Grover, PA Quadrangle 41°32`19"N, 76°45`22"W);

 (3) A temporary road crossing using a wood mat bridge and a 16 inch diameter gathering line impacting 138 linear feet of an unnamed tributary to Fall Run (EV) (Grover, PA Quadrangle 41°32`19"N, 76°45`29"W);

 (4) A temporary road crossing using timber mats and a 16 inch diameter gathering line impacting 541 square feet of an exceptional value palustrine emergent (PEM) wetland (Grover, PA Quadrangle 41°32`16"N, 76°45` 35"W);

 The project will result in 5,930 square feet of temporary wetland impacts and 330 linear feet of temporary stream impacts for the purpose of installing a gathering line for Marcellus well development in Fox Township, Sullivan County. The permittee will provide 0.22 acre of compensatory mitigation for impacts throughout the project and at the Wilmot Site (Colley, PA Quadrangle 41°36`44"N 76°17` 27"W) in Wilmot Township, Bradford County.

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483.
