The facility is a major facility due to its potential to emit of oxides of nitrogen and oxides of sulphur. The facility is subject to the Compliance Assurance Monitoring Rule (CAM) found in 40 C.F.R. Part 64. Appropriate permit conditions to address the applicable CAM requirements have been included in the permit.

62-00032: Ellwood National Forge Company/Irvine (1 Front Street, Irvine, PA 16329-1801), on June 21, 2011, issued an administrative amendment to the Title V Operating Permit to incorporate the plan approval 62-032G requirements for the facility located in Brokenstraw Township, Warren County.

The De minimis emission increase is for the widening of a conveyor, the extension of a conveyor from 600 to 1000 feet, and the addition of three conveyors totaling 295 feet in length. In addition, this source is exempt from plan approval as it complies with 25 Pa. Code § 127.449.

SMP#17100109, Sky Haven Coal, Inc., 5510 State Park Road, Penfield, PA 15849. Application is for a proposed project located in Boggs Township, Clearfield County and will involve the remining of abandoned surface mined land. Wetlands that have developed in the abandoned pits will be affected and replaced at the conclusion of the mining. Total wetlands to be affected are 0.4 acre which will be replaced with 1.03 acres of wetlands. This proposal is approved on June 22, 2011. In conjunction with this approval, the Department is granting 401 Water Quality Certification certifying that the approved activities will comply with the applicable provisions of sections 301-303, 306 and 307 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341) and will not violate applicable Federal and State water quality Standards.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. Request for Comments on the Proposed Total Maximum Daily Loads (TMDLs) Developed for the West Branch Mahantango Creek Watershed in Snyder and Juniata Counties Pennsylvania

 The Department of Environmental Protection will accept comments on the proposed TMDLs developed for the West Branch Mahantango Creek Watershed in Snyder and Juniata Counties, PA. These TMDLs were established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in this watershed. The listings of these waterbodies were due to use impairments caused by excessive siltation from agriculture.

 There currently are no state or federal instream numerical water quality criteria for siltation. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. These proposed TMDLs set allowable loadings of sediment in the West Branch Mahantango Creek Watershed. The sediment loadings were allocated among cropland, hay/pasture land, low intensity development and stream bank categories present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University.

 The following table shows the estimated current sediment loadings for the watershed. Overall load reductions necessary in order to meet the TMDLs are also identified.
