Extension of National Pollutant Discharge Elimination System (NPDES) General Permit (PAG-13) Stormwater Discharges from Small Municipal Separate Storm Sewer Systems (MS4s)

   Under the authority of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and sections 1905-A, 1917-A and 1920-A of The Administrative Code of 1929 (71 P. S. §§ 510-17 and 510-20), the Department of Environmental Protection (Department) is, by this notice, extending for 12 months the availability of the current NPDES General Permit (PAG-13) Stormwater Discharges from Small Municipal Separate Storm Sewer Systems (MS4s). The current PAG-13 permit is scheduled to expire at midnight March 9, 2008, unless rescinded by the Department at an earlier date. The extension will be effective on March 10, 2008, and will expire at midnight on March 9, 2009. The Department is extending the availability of this permit to adequately complete the preparation of the renewal of PAG-13. The Department is also extending, by this notice, all existing MS4 PAG-13 permit approvals and waivers scheduled to expire. MS4s discharging, under the existing PAG-13, are authorized to continue the discharge in accordance with the terms and conditions of the PAG-13 permit and to comply with the PAG-13 permit requirements. Included in this extension is the requirement to continue implementation of the existing program and to provide annual reports on the progress of program implementation.

   The existing PAG-13 permit documents will continue to be available from the Department's regional offices and local county conservation districts until they are replaced or updated. In addition, the permit documents are on file at the Department, Bureau of Watershed Management, 10th Floor, Rachel Carson State Office Building, 400 Market Street, Harrisburg, PA 17101.
