FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications and requests for Environmental Assessment approval and requests for Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341(a)) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Initial requests for 401 Water Quality Certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8 a.m. and 4 p.m. on each working day at the office noted before the application.

   Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

WATER OBSTRUCTIONS AND ENCROACHMENTS

   Southeast Region:  Water Management Program Manager, Lee Park, Suite 6010, 555 North Lane, Conshohocken, PA 19428.

   E09-833. JDA Development Co. LLC, 29 South Main Street, West Hartford, CT 06107, Middletown and Bristol Townships, Bucks County, ACOE Philadelphia District.

   To place and maintain fill and appurtenant structures in 0.96 acre of wetland (PFO) within the Mill Creek (WWF) watershed associated with the construction of a Giant Food Store. Consisting of 64,000-square feet of commercial space. The applicant proposes to compensate wetland losses by constructing both onsite and offsite replacement wetland areas, totaling 0.96 acre. This application is being reviewed concurrently with E09-834 located immediately downstream in Bristol Township. The site is located along the northern side of New Falls Road (S.R. 2049) between Durham Road (S.R. 2006) and New Rodgers Road (S.R. 0413) (Langhorne, PA USGS Quadrangle N:  1.6 inches; W:  1.7 inches).

   E09-834. Bristol Township, 2501 Bath Road, Bristol, PA 19007, Middletown Township, Bucks County, ACOE Philadelphia District.

   To modify 688 linear feet of unnamed intermittent tributary of Mill Creek (WWF) and to modify and maintain an existing stream enclosure by placing approximately 1,115 linear feet of PEP stream enclosure consisting of segments with 36-inch, 42 inch and 48 inch diameters. The enclosure will approximately follow along an existing 980-foot long stream enclosure. The work is proposed for the purpose of improving the conveyance of stormwater flows resulting for anticipated upstream development. This application is being review concurrently with E09-833 located immediately upstream in Middletown Township. The stream channel and enclosure modifications are located along a reach of the tributary starting along southern side of New Falls Road (S.R. 2049) approximately 400 feet east of Durham Road (S.R. 2006) continuing downstream approximately 2,000 feet under New Rodgers Road (S.R. 0413) to an end wall located immediately east of the junction of Prunewood Drive and Plumbridge Road (Langhorne, PA USGS Quadrangle N:  0.9 inch; W:  0.7 inch).

   E46-876. The Philadelphia Cricket Club, 415 West Willow Grove Avenue, Philadelphia, PA 19118, Whitemarsh Township, Montgomery County, ACOE Philadelphia District.

   To amend permit E46-876 for the following water obstruction and encroachment activities which impacted a total of 898 linear feet of Lorraine Run (TSF), unnamed tributaries and will impact 0.36 acre of adjacent wetland (PFO) associated with the construction of the Philadelphia Cricket Club Golf Course:

   1.  To maintain 13 stormwater outfalls.

   2.  To maintain eight golf cart bridges.

   3.  To eliminate the construction of a golf course pond along the bank and within the floodway of Lorraine Run associated with mining permit associated with hole No. 13.

   4.  To maintain fill within approximately 570 linear feet of an unnamed tributary to Lorraine Run associated with the construction of a new settling pond in accordance with mining permit No. 8074SM2T2 and to maintain 260 linear feet of constructed channel originating at the mining discharge point.

   5.  To include the placement of approximately 0.2 acre of fill within wetlands (PEM) associated with modification to the fairway for Hole No. 18.

   The site is bounded by Joshua Road and Fort Washington State Park to the north, West Valley Green Road to the south and Stenton Avenue to the west (Germantown, PA Quadrangle N:  20.05 inches; W:  15.0 inches). The applicant proposes to provide 1.0 acre of replacement wetlands.

   E06-562. Jeffrey Smallman, Pennsylvania Department of Transportation 5-0, 1713 Lehigh Street, Allentown, PA 18103 in Spring and South Heidelberg Townships, Berks County, ACOE Philadelphia District

   To remove the existing structure and to construct and maintain a single 53-foot span concrete bridge with an average underclearance of 407 feet over Cacoosing Creek (WWF) on Mountain Home Road (SR 3012, Segment 0052, Offset 0000) and to fill in 0.05 acre of de minimis wetlands in order to realign the road located 1,500 feet north of Montello Village (Sinking Spring, PA Quadrangle N:  12.1 inches; W:  5.95 inches) in Spring and South Heidelberg Townships, Berks County. The amount of wetland impact is considered a de minimis impact of 0.05 acre and wetland mitigation is not required.

   E07-355. Michael Fiore, PA Investor Enterprises, LLC, 5506 6th Avenue, Rear, Altoona, PA 16602 in Allegheny Township, Blair County, ACOE Baltimore District.

   To construct and maintain a 400-foot long, 7-foot by 2.5-foot concrete box culvert stream enclosure, to relocate 363 feet of stream channel and to construct three outfalls in and along the channel of a tributary to Burgeon Run (WWF) at a point between Route 764 and California Avenue for the purpose of constructing a shopping plaza (Hollidaysburg, PA Quadrangle N:  15.75 inches; W:  7.0 inches) in Allegheny Township, Blair County.

   E50-208. Ron Hampton, Saville Township, 46 Butcher Shop Lane, Elliottsburg, PA 17024 in Saville Township, Perry County, ACOE Baltimore District.

   To remove an existing bridge and to construct and maintain a bridge having a span of 48.6 feet and an underclearance of 6 feet across the channel of Buffalo Creek (HQ-CWF) at a point at T-324 (Valentine Road) (Spruce Hill, PA Quadrangle N:  10.8 inches; W:  5.8 inches) in Saville Township, Perry County.

   E67-713. Tom Simmons, Mid-Atlantic Realty Trust, 170 West Ridgely Road, Luterville, MD 21093 in Shrewsbury Borough and Hopewell Township, York County, ACOE Baltimore District

   To:  (1) extend an existing 72-inch corrugated metal pipe culvert by 30-feet, 15-feet on each side of the culvert; (2) remove an existing 30-inch corrugated metal pipe and construct a 72-inch corrugated metal pipe and construct an 8-inch sanitary sewer pipe across an unnamed tributary to Deer Creek; (3) construct a 21-inch and a 24-inch outfall stormwater discharge pipe; (4) remove an existing 5.5-foot by 7-foot concrete box culvert and construct and maintain a 4.5-foot by 10-foot precast concrete box culvert; and (5) relocate and maintain approximately 490 linear feet of Deer Creek (CWF) for construction of the Shrewsbury Commercial Center located between I-83, Route 851 and Mount Airy Road (Glen Rock, PA Quadrangle N:  4.25 inches; W:  6.5 inches) in Shrewsbury Borough and Hopewell Township, York County.

   E12-128. Department of Conservation and Natural Resources, R. R. 4, Box 212, Suite 1, Emporium, PA 15834. Stillhouse Run Stream Bank Stabilization, in Lumber Township, Cameron County, ACOE Baltimore District (Cameron, PA Quadrangle N:  10.5 inches; W:  7.5 inches).

   The Department of Conservation and Natural Resources is requesting a permit application to use R-5 riprap to stabilize a total of 155 linear feet of stream bank in two different locations. The project is located on Stillhouse Run, which is designated as a High Quality Cold Water Fishery.

   E18-332. Department of Conservation and Natural Resources, P. O. Box 8451, Harrisburg, PA 17105. Bridge Replacement, in Noyes Township, Clinton County, ACOE Baltimore District (Renovo West, PA Quadrangle N:  12.5 inches; W:  14.8 inches).

   To:  1) remove an existing bridge; 2) construct and maintain a precast reinforced concrete box culvert with 17.0-foot wide by 4.0-foot high effective hydraulic opening, precast end sections and 1.0-foot high concrete fish baffles; 3) construct and temporarily maintain three 30-inch plastic pipes for a temporary stream bypass, in Huling Branch located 0.3 mile up Two Mile Run from Kettle Creek Road (Renovo West, PA Quadrangle N:  12.5 inches; W:  14.8 inches) in Noyes Township, Clinton County. The project proposes to permanently impact 150 feet of Huling Branch, which is a Trout Stocked Fishery.

   E41-499. Loyalsock Township, 2501 East Third Street, Williamsport, PA 17701. Miller Run Stream Restoration, in Loyalsock Township, Lycoming County, ACOE Baltimore District (Montoursville, PA Quadrangle N:  1.5 inches; W:  13.25 inches).

   The applicant is proposing to restore 750 linear feet of Miller Run, which is designated as a Warm Water Fishery. The restoration will take place through the Bruce E. Henry Park and will utilize Fluvial Geomorphic Principles to complete the project. Several in-stream rock structures and minor stream relocation are proposed in the application.

   E49-257. Shamokin Township Supervisors, R. R. 1, Box 459, Paxinos, PA 17860. Water Obstruction and Encroachment Joint Permit Application, in Shamokin Township, Northumberland County, ACOE Susquehanna River Basin District (Treverton, PA Quadrangle N:  16.6 inches; W:  2.3 inches).

   To remove existing culvert pipe and construct and maintain a corrugated metal arch pipe having a span of 6.92 feet and a rise of 4.75 feet in an unnamed tributary to Shamokin Creek along T-485. This project proposes to permanently impact 60 linear feet of the unnamed tributary, which is, designated a Cold Water Fishery and does not propose to impact any jurisdictional wetlands.

   E02-1363. Allegheny County Department of Public Works, 501 County Office Building, 542 Forbes Avenue, Pittsburgh, PA 15219. Ohio Township and Sewickley Hills Borough, Allegheny County, ACOE Pittsburgh District.

   To remove the existing bridge and to construct and maintain a 46` x 11` x 6` reinforced box culvert (depressed 1') in a tributary to Kilbuck Run (CWF) and to remove existing structures, to replace and maintain a 284' section of retaining wall and to construct and maintain two outfall structures along the right bank side of Kilbuck Run (CWF). The project is located along Glenfield Road approximately 1/4 mile south of its intersection with Mt. Nebo Road (Emsworth, PA Quadrangle N:  8.8 inches; W:  17.1 inches)

   E65-794. Greater Greensburg Sewage Authority, P. O. Box 284, Greensburg, PA 15601-0248. Borough of South Greensburg, Westmoreland County, ACOE Pittsburgh District.

   To construct and maintain a 48-inch RCP storm sewer outfall along Jacks Run (WWF) as part of the replacement of an existing combined sewer system with separate stormwater sewer and sanitary sewer systems. The project is located on Huff Avenue off of U. S. Route 119 (Greensburg, PA Quadrangle N:  5.3 inches; W:  7.1 inches).

   E65-795. Humane Society of Westmoreland County, P. O. Box 1552, Greensburg, PA 15601. Hempfield Township, Westmoreland County, ACOE Pittsburgh District.

   To operate and maintain a single span bridge having a normal span of 24.0 feet and an underclearance of 5.5 feet across Jack's Run (WWF) authorized for construction under Emergency Permit No. EP6501201. The bridge is located off of S.R. 119 (Greensburg, PA Quadrangle N:  11.0 inches; W:  4.0 inches).

   E65-796. Colony Development Company, 8954 Hill Drive, North Huntingdon, PA 15642. Unity Township, Westmoreland County, ACOE Pittsburgh District.

   To place and maintain fill in 0.72 acre of wetlands in the watershed of unnamed tributaries to Ninemile Run (WWF) for the purpose of a commercial site development for Big Kmart and Lowe's Improvement Warehouse. The site is located along S.R. 30 approximately 0.5 mile south of the intersection of Theater Drive (T-898) and S.R. 30 (Latrobe, PA Quadrangle N:  6.9 inches; W:  1 inch).

   Northwest Region:  Water Management Program Manager, 230 Chestnut Street, Meadville, PA 16335-3481.

   E10-351, Butler County, Government Center, P. O. Box 1208, Butler, PA 16003-1208, Rosebaugh Bridge over Glade Run, in Adams Township, Butler County, ACOE Pittsburgh District (Valencia, PA Quadrangle N:  18 inches; W:  13.7 inches).

   Project involves the replacement of the Rosebaugh Bridge over Glade Run (WWF). The proposed structure is a single span composite prestressed concrete box beam bridge with a clear span of 15.05 meters. The bridge is located on Hammond Road near the intersection of Hammond Road, List Hill Road and Three Degree Road in Adams Township, Butler County.

   E25-404A, Erie-Western Pennsylvania Port Authority, 100 State Street, Suite 205, Erie, PA 16507. Maintenance Dredging in Presque Isle Bay and Lake Erie, in the City of Erie, Erie County, ACOE Pittsburgh District.

   To amend Permit No. E25-404A which authorizes the Erie-Western Pennsylvania Port Authority to perform maintenance dredging at the following eight locations in and along Presque Isle Bay and Lake Erie in the City of Erie, Erie County:

   1.  Chestnut Street launch ramp (Erie North, PA Quadrangle N:  1.25 inches; W:  13.25 inches).

   2.  West Canal Basin (Erie North, PA Quadrangle N:  2.0 inches; W:  12.2 inches).

   3.  East Canal Basin (Erie North, PA Quadrangle N:  2.4 inches; W:  12.3 inches).

   10.  Bay Harbour Marina (Erie North, PA Quadrangle N:  1.0 inch; W:  14.4 inches) approximately 6 acres.

   11.  Commodore Perry Yacht Club (Erie North, PA Quadrangle N:  1.1 inches; W:  14.1 inches) approximately 14 acres.

   E25-638, Greater Erie Industrial Development Corporation, 5240 Knowledge Parkway, Erie, PA 16510-4658. Fairview Business Park--GEIDC, in Fairview Township, Erie County, ACOE Pittsburgh District (Swanville, PA Quadrangle N:  1.5 inches; W:  16.0 inches).

   To fill a total of 3.53 acres of seven nonexceptional value wetlands at the Fairview Business Park--GEIDC for lot development on the former Commodore Downs property located northeast of the intersection of I-90 and S.R. 98 (Exit 16). Project includes creation of 4.22 acres of replacement wetlands.

   E25-641, Department of Conservation and Natural Resources, 195 Park Road, P. O. Box 387, Prospect, PA 16052-0387, East Fisher Road over Graveyard Pond, in Millcreek Township, Erie County, ACOE Pittsburgh District (Erie North, PA Quadrangle N:  5.5 inches; W:  12.6 inches).

   To construct and maintain a prestressed adjacent box beam bridge with a single clear span of 120 feet, an underclearance of 21`-10" at mid-span, a skew of 90 degrees and two reinforced concrete abutments across Graveyard Pond (WWF), located of East Fisher Road (USGS Quad:  Erie North, N:  5.5 inches, W:  12.6 inches), in Millcreek Township, Erie County. The estimated waterline disturbance is 180 feet with 650 square feet of wetland impact.

   To widen an existing prestressed concrete adjacent box beam bridge 4 feet for the purpose of adding a bikeway and sidewalk along Long Pond (WWF) on Marina Drive (USGS Quad:  Erie North, N:  6.3 inches, W:  16.1 inches) in Millcreek Township, Erie County. The estimated waterline disturbance is 135 feet with no permanent wetland impact.

   E25-642, Washington Township, 11800 Edinboro Road, Edinboro, PA 16214, Washington Township Peninsula Park, in Washington Township, Erie County, ACOE Pittsburgh District (Edinboro North, PA Quadrangle N:  3.4 inches; W:  2.2 inches).

   Construction and maintenance of picnic pavilions, grill facilities, composting toilets and sidewalks in an existing park along Edinboro Lake/Conneauttee Creek (WWF). The project is not location in the floodway, does not impact wetlands and does not project into any watercourse. The location of the proposed facilities is the floodplain of Edinboro Lake/ Conneauttee Creek. Approximately 0.1 acre of existing gravel driveways and an existing mowed yard will be disturbed.

INDUSTRIAL WASTE AND SEWERAGE WASTEWATER

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval.

   Persons aggrieved by these actions may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period.    NPDES Permit No. PA0057126, Industrial Waste, Amerada Hess Corporation, 1 Hess Plaza, Woodbridge, NJ 07095. This proposed facility is located in City of Coatesville, Chester County.

   Description of Proposed Action/Activity:  Renewal to discharge into West Branch of Brandywine Creek-3H.

   Northeast Region:  Water Management Program Manager, 2 Public Square, Wilkes-Barre, PA 18711-0790.

   NPDES Permit No. PA-0060496, Sewage, C. S. Water and Sewer Associates, P. O. Box 866, Moscow, PA 18444. This proposed facility is located in Lackawaxen Township, Pike County.

   Description of Proposed Action/Activity:  renewal of NPDES Permit to discharge treated wastewater from the existing treatment facility into the Delaware River.

   NPDES Permit No. PA-0023558, Sewage, Borough of Ashland, 502 Chestnut Street, Ashland, PA 17921. This proposed facility is located in Ashland Borough, Schuylkill County.

   Description of Proposed Action/Activity:  Authorized to discharge to Mahanoy Creek. Renewal of NPDES permit.

   WQM Permit No. 4801404, Sewerage, Nazareth Borough Municipal Authority, 872 Tatamy Road, P. O. Box A, Nazareth, PA 18064. This proposed facility is located in Upper Nazareth Township, Northampton County.

   Description of Proposed Action/Activity:  Construction of Pump Station.

APPROVALS TO USE NPDES AND/OR OTHER GENERAL PERMITS
