   PA-10-0062A:  Slippery Rock University (Slippery Rock, PA 16057-1326), for modification of Boiler No. 1 and No. 2 at the maintenance facility in Slippery Rock, Butler County. This modification will result in the reduction of NOx and particulate emissions. The facility will be required to comply with fugitive, particulate matter, odor and visible emission standards of 25 Pa. Code Chapter 123. The facility will conduct stack tests to confirm compliance with the particulate emission standards. The Plan Approval and Operating Permit will contain additional recordkeeping and operating restrictions designed to keep the facility operating within all applicable air quality requirements.

MINING

APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.31); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes:  the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection. A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for such certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code § 86.31--34 and § 77.121--23 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

   Where any of the mining activities listed below will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52, and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity, and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume, or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submit-ting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

APPLICATIONS

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection. Section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), requires the state to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant state requirements. Initial requests for 401 certification will be published concurrently with the permit application. Persons objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit any comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted above the application.

To construct and maintain two new Mooring Dolphins 1A and 15A at the existing Berth A and Berth B facilities connected to the existing dolphins by a catwalk supported by ten 12-inch diameter concrete filled pipe pilings. The Mooring Dolphins will consist of 23-foot by 17-foot reinforced concrete platforms each supported by approximately sixteen, 14-inch diameter concrete filled pipe pilings. These activities are located at the Fort Mifflin Terminal located on Hog Island Road along the right bank of the Delaware River (Woodbury, NJ-PA Quadrangle N:  21.5 inches; W:  13.3 inches) in Tinicum Township, Delaware County and the City and County of Philadelphia. This permit also authorizes the maintenance of all previous mooring and docking facilities authorized under Permit E2378713T-1.

To construct and maintain three 54-inch diameter reinforced concrete pipe by 110 feet stream enclosure and to fill in 0.072 acre of de minimis wetland to construct Eliza Way for the proposed housing development called Watts Tract located about 2,000 feet north of the Good Hope Road and Smith Drive intersection (Harrisburg, PA Quadrangle N:  5.5 inches; W:  16.5 inches) in Hampden Township, Cumberland County.

   E21-302. Encroachment. UGI Utilities, Inc., 1500 Paxton Street, P. O. Box 3565, Harrisburg, PA 17015. To construct and maintain a 4-inch diameter gas line to be fastened at the downstream side of the Bridge Road bridge (SR 1015) across the Conodoguinet Creek to supply gas to customers (Harrisburg West, PA Quadrangle N:  4.9 inches; W:  10.4 inches) in East Pennsboro Township, Cumberland County.

   E36-682. Encroachment. Bent Creek Country Club, 2345 Quarry Road, Lititz, PA 17543. To construct and maintain a 20-foot span and a 160-foot span footbridge supported on 18-inch diameter concrete pilaster bases spaced at 10-foot centers across the Little Conestoga Creek (WWF) located at the Bent Creek Country Club for pedestrian access between the golf course (Lancaster, PA Quadrangle N:  22.0 inches; W:  15.0 inches) in Manheim and East Hempfield Townships, Lancaster County.

   E18-283. Encroachment. James Eppley, Chief, Bureau of Facility Design, P. O. Box 8451, Harrisburg, PA 17754. To remove the existing culverts and construct and maintain 46 plastic 18-inch and 24-inch 30-foot long culvert pipes with their associated outfalls that comprise the stream crossing and drainage pipes for Abes Road and Hyner Run Road that are in or outfall to the main branches and the tributaries of Abes Run and Left Branch Hyner Run, respectively. The encroachments are located upstream of the confluence of the left and right branch of Hyners Run on the above mentioned roads (Slate Run, PA Quadrangle N:  1.0 inch; W:  15.0 inches) in Chapman Township, Clinton County. This project proposes to permanently impact a maximum of 1,800 linear feet of Abes Run and Left Branch Hyner Run, which are designated a cold water fisheries.

   E18-287. Encroachment. Dennis J. Castonguay, International Paper Company, P. O. Box 268, Lock Haven, PA 17745-0268. To remove the existing structure and to construct and maintain an elliptical corrugated metal pipe 76 inches high by 117 inches wide by 60 feet long in the Pennsylvania Canal to provide a travel way to the International Paper Company. The project is located off Park Street at the southwest corporate limits of the City of Lock Haven (Lock Haven, PA Quadrangle N:  0.25 inch; W:  11.0 inches) in Castanea Township, Clinton County. The project does not impact on wetlands while impacting approximately 90 feet of waterway. The Pennsylvania Canal is a warm water fisheries stream.

   E19-196. Encroachment. PA Dept. of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754. To 1)  rehabilitate and maintain a Pony Truss Bridge with a single span of 110-foot 5-inches and an underclearance of 9-foot 6-inches across Fishing Creek, 2)  place and maintain 75 feet of rock slope protection on the right bank of Culley Run, both of which are located 0.75 mile west of SR 254 from its intersection with SR 487 (Benton, PA Quadrangle, N:  9.41 inches; W:  1.74 inches) in Benton Township, Columbia County. This project proposes to temporarily impact Fishing Creek by constructing a temporary cofferdam, permanently impact 110 feet of Fishing Creek by maintaining the bridge and to permanently impact 75 feet of Culley Run by placing the rock protection. Both streams are classified as cold water fisheries.

   E41-455. Encroachment. Pennsylvania Department of Transportation, Engineering District 3-0, P. O. Box 218, Montoursville, PA 17754-0218. To remove the existing structure and to construct and maintain a concrete box culvert with a span of 12 feet and underclearance of 10 feet in an unnamed tributary to West Branch Susquehanna River located on S. R. 2012, Section 003 approximately 1.5 miles east of the boundary of South Williamsport Borough (Montoursville South, PA Quadrangle N:  20.3 inches; W:  10.8 inches) in Armstrong Township, Lycoming County. Estimated stream disturbance is 100 feet; stream classification is CWF.

   E55-159. Encroachment. Paul Heise, Pennsylvania Department of Transportation, P. O. Box 218, 715 Jordan Avenue, Montoursville, PA 17754-0218. To remove the existing structure and to construct and maintain a single span concrete box beam bridge skewed 80° right ahead with a normal span of 40 feet and a minimum underclearance of 6 feet and a temporary stream crossing with four 48-inch diameter pipes. The project is located on SR 1003 over Dry Run approximately 0.5 mile east of the intersection of SR 1003 with RT 104 (Middleburg, PA Quadrangle N:  16.5 inches; W:  6.0 inches) in Centre Township, Snyder County. The project will not impact on wetlands while impacting approximately 50 feet of waterway. Dry Run is a cold water fisheries stream.

   E59-394. Encroachment. Wal-Mart Realty, 2001 Southeast Tenth Street, Bentonville, AR 72712-6489. To install and maintain rock streambank protection in and along Canoe Camp Creek (a cold water fishery); and to construct, operate and maintain a stormwater outfall along the same waterway for the expansion of an existing commercial facility. The streambank protection work shall consist of regrading existing streambanks to a minimum slope of 1-foot vertical to 3-feet horizontal and installing a minimum of 500-feet of R-7 riprap. The stormwater outfall shall be constructed with a 30-inch diameter polyethylene pipe with a concrete headwall. The project will not impact wetlands while impacting 500 feet of waterway. The project is located along the eastern right-of-way of S. R. 0015 approximately 500 feet north of S. R. 2027 and S. R. 0015 intersection (PA Quadrangle N:  6.1 inches; W:  9.2 inches) in Richmond Township, Tioga County.

To construct and maintain stream crossing consisting of two 4-foot diameter culverts and three 2-foot diameter culverts in the channel of Longs Run (unnamed tributary to Raccoon Creek) (WWF) to provide access to applicant's property located on the south side of Longs Run Road (T-531), approximately 1,600 feet east from the intersection of Longs Run Road (T-531) and T-494 (Aliquippa, PA Quadrangle N:  10.1 inches; W:  14.5 inches) in Independence Township, Beaver County.

   E63-479. Encroachment. New Eagle Borough Municipal Sewer Authority, 157 Main Street, New Eagle, PA 15067. To place and maintain fill on the left bank of the Monongahela River for the purpose of constructing a sewage treatment plant located on the north side of Main Street, approximately 1,800 feet west from the intersection of Main Street and S. R. 136 (Monongahela, PA Quadrangle N:  15.3 inches; W:  9.9 inches) in New Eagle Borough, Washington County.

To remove the existing structure and to construct and maintain a steel I-beam bridge having a single clear span of 21.5 feet and a maximum underclearance of 4.5 feet across a tributary to Little Buffalo Creek (HQ-CWF) to provide private access to the Saxonburg District Sportsman Association. The project is located across a tributary to Little Buffalo Creek approximately 4,000 feet northwest of the intersection of SR 2018 and Bear Creek Road in the village of Sarver (Curtisville, PA Quadrangle N:  21.1 inches; W:  0.2 inch) located in Buffalo Township, Butler County.

   E20-432. Encroachment. PA DCNR, Western Engineering Office, 195 Park Road, P. O. Box 387, Prospect, PA 16052-0387. To amend Permit No. E20-432 which authorized the Pennsylvania Department of Conservation and Natural Resources to construct and maintain a 60-foot-wide by 525-foot-long rock armored earthfill breakwater with an attached 280-foot-long floating wave attenuator and a 150-slip floating dock marina in Pymatuning Reservoir at the Espyville Boat Livery located along North Lake Road (T-302) approximately 800 feet north of SR 285 (Andover, OH-PA Quadrangle N:  19.6 inches; W:  0.35 inch) in North Shenango Township, Crawford County. The requested amendment is to remove the floating wave attenuator and to construct and maintain an additional 325 feet of rock armored solid fill breakwater.

   E25-596. Encroachment. PA Dept. of Transportation, Engineering District 1-0, 255 Elm Street, P. O. Box 398, Oil City, PA 16301. To remove the existing structure and to construct and maintain a prestressed concrete box beam bridge having a single clear span of 51.0 feet and an underclearance of 10.0 feet on SR 5 across Raccoon Creek (CWF, MF). The project is located on SR 5 across Raccoon Creek approximately 0.3 mile southwest of the intersection of SR 5 and SR 3009 (East Springfield, PA Quadrangle N:  16.2 inches; W:  11.5 inches) located in Springfield Township, Erie County.

   E25-599. Encroachment. PA Dept. of Transportation, Engineering District 1-0, 255 Elm Street, P. O. Box 398, Oil City, PA 16301. To remove the existing structure and to construct and maintain a prestressed concrete adjacent box beam bridge having a single clear span of 72 feet and an average underclearance of 6.91 feet on SR 3013 across East Branch Conneaut Creek (CWF, MF). The project is located on SR 3013 across East Branch Conneaut Creek approximately 0.28 mile north of the intersection of SR 3013 and SR 6 in the Borough of Albion (Albion, PA Quadrangle N:  3.6 inches; W:  16.0 inches) located in Borough of Albion, Erie County.

   E62-358. Encroachment. Bingaman and Son Lumber Inc., East Main Street, Box 247, Kreamer, PA 17833. To place and maintain approximately 192 cubic yards of fill within the 100-year-floodway of a tributary to West Branch Tionesta Creek. This fill will allow for placement of a concrete pad around kilns. The project is located along a tributary to West Branch Tionesta Creek at 22 East Brown Avenue in the Borough of Clarendon approximately 1,700 feet northwest of the intersection of SR 2006 and SR 6 (Clarendon, PA Quadrangle N:  5.5 inches; W:  13.5 inches) located in the Borough of Clarendon, Warren County.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Any person aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. APPROVALS TO USE NPDES AND OTHER GENERAL PERMITS

   The following parties have submitted (1)  Notices of Intent (NOIs) for coverage under General NPDES Permit(s) to discharge wastewater into the surface waters of this Commonwealth; (2)  NOIs for coverage under General Permit(s) for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania; or (3)  Notifications for First Land Application of Sewage Sludge.

   The approval of coverage under these General Permits may be subject to one or more of the following:  pollutant or effluent discharge limitations, monitoring and reporting, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection (Department) has reviewed the NOIs and determined that they comply with administrative requirements of the respective permit application. Also, the Department has evaluated the First Land Application of Sewage Sludge for the sites applying for coverage under PAG-7, PAG-8 and PAG-9 and determined that the sites are suitable for land application of sewage sludge.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision:  40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangement made for copying at the contact office noted.
